Version v1.0 — Effective 2026-05-03
By accessing or using any [State] Gun Trader site (the "Service" — including without limitation the per-state sites operated by the Company under the [State] Gun Trader brand family), you agree to be bound by these Terms. You must be 18 years of age or older and a resident of the United States. The Service is not available outside the US.
The Service is an "interactive computer service" as defined in 47 U.S.C. § 230(f)(2). Users are the sole "information content providers" for all listings, messages, and materials submitted to the Service. The Service does not create, develop, or materially contribute to user-generated content. The Service exercises only traditional editorial functions of a publisher (including the right but not the obligation to remove content) and does not pre-screen, verify, endorse, or guarantee the accuracy of any listing, user identity, or transaction.
All categorization, search, and filtering features are neutral organizational tools applied uniformly without regard to listing content.
The Service does not broker, escrow, facilitate, process, or participate in any transaction between users. All transactions occur off-platform and are solely between buyer and seller. The Company is not a party to any sale, has no knowledge of completed transactions, and disclaims all responsibility for transaction outcomes including but not limited to non-delivery, item condition, legality of sale, or buyer/seller conduct.
By posting any listing, you certify under penalty of perjury that:
The following are prohibited from listing on the Service:
The following conduct is prohibited:
You agree to comply with the firearms laws of your state of residence. The Service displays per-state compliance information (UBC routing, FFL transfer requirements, permit requirements, magazine and assault-weapon restrictions) as a courtesy, but you are solely responsible for verifying and following current law.
You retain ownership of content you submit. By posting, you grant the Service a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and distribute that content for the purpose of operating the Service.
If you believe content on the Service infringes your copyright, send a notice to our designated DMCA agent at /legal/dmca. We will respond as required by 17 U.S.C. § 512.
The service is provided "as is" and "as available." The company makes no representations regarding the identity, age, residency, legal status, or intentions of any user, or the accuracy, legality, or safety of any listing. Users interact at their own risk and are solely responsible for due diligence including identity verification and background-check compliance.
To the maximum extent permitted by law, the company's aggregate liability arising out of or relating to the service shall not exceed one hundred dollars ($100). The company shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.
You agree to defend, indemnify, and hold harmless the Company, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your listings, messages, or other content; (b) your use of the Service; (c) your violation of these Terms; (d) your violation of any law; (e) any transaction or attempted transaction with another user; or (f) any misrepresentation in your user certifications. The Company reserves the right to assume the exclusive defense of any matter for which you are obligated to indemnify, and you agree to cooperate fully. This obligation survives termination.
We may suspend or terminate your account at any time for any reason. You may delete your account at any time via Account Settings.
Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator, not any court, shall have exclusive authority to resolve all threshold issues including arbitrability, scope, and enforceability.
Class, collective, and representative actions are waived. If the class waiver is held unenforceable, the entire arbitration provision is void and disputes proceed in court, but the class waiver is severable from the rest of these Terms.
You may opt out of arbitration by sending written notice to the Company at the address in Section 16 within 30 days of first accepting these Terms.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles.
We may modify these Terms at any time. Material changes will be communicated via email or in-app notice. Continued use after notice constitutes acceptance.
